1. Scope
These terms apply to every order placed at www.cacauwe.com. The seller trades as Cacauwe. The version that applies to your order is the one published on the day you ordered.
2. The products
We sell clothing, cacao, tea and other food, and objects used in ceremony, to consumers. Natural materials, hand prints and stones vary from piece to piece, and that variation is not a defect.
Food is sold as food. We make no health or medical claims, and nothing on this site is medical advice.
3. Prices
Prices are in EUR. USD prices are converted from EUR at the shop's current rate. Shipping is added at checkout and shown before you pay. Prices exclude import duties and taxes of the destination country, paid by the customer on delivery (DAP). Import duties and any carrier handling fee are not included; see section 6.
If a price is obviously wrong, for example a decimal point in the wrong place, we may cancel the order and refund you in full instead of shipping at that price.
4. Orders
Putting items in the cart is not an order. When you place an order you make an offer; the contract is formed when we confirm the order to you. If an item turns out to be unavailable, we tell you and refund that item.
You must be 18 or older to order. Keep your account password to yourself.
5. Payment
Payment is by bank transfer, in full, in the currency of your order. We ship once the transfer arrives. The steps are on the Payment page.
6. Delivery
Orders ship from our makers. The Shipping page says where they are, and gives the options, prices and estimated delivery times. Orders are delivered DAP (delivered at place). When your order ships from another country, it is an import into yours. Any import duty, import tax or carrier handling fee that your country charges is collected on delivery and paid by you. Risk in the goods passes to you when the parcel is delivered.
7. Right of withdrawal
As a consumer you can withdraw from the contract within 14 days of delivery without giving a reason. Food opened after delivery is excluded. How it works, and the model form, are on the Right of Withdrawal page.
8. Warranty
Consumers have the legal guarantee of conformity: 3 years for new goods (Decreto-Lei 84/2021). If an item is faulty, tell us and we repair, replace, reduce the price or refund. This is in addition to the right of withdrawal.
9. Liability
Our liability is the one the law sets. How you prepare cacao, burn incense or play an instrument is your responsibility. Nothing here limits liability for death, personal injury or anything else that cannot be limited by law.
10. Complaints and disputes
Write to [email protected] first. If we cannot agree, consumers can take the dispute to an approved alternative dispute resolution body; the European Commission keeps the list at consumer-redress.ec.europa.eu.
These terms are governed by Portuguese law. This does not take away the protection of the mandatory law of your country of residence.
